Republicans argue that no one should be fired for leaking classified material and the name of a CIA covert agent and praise Bush for flip flopping to say that he’ll only fire Karl Rove if Rove committed a crime.
Was a crime committed here? Let’s legally examine the statute, as well as the crimes of perjury and obstruction of justice: (Click to blog to read entire statute.) Consider it your first taste of law school.
But don’t forget perjury and obstruction. As with Watergate, the cover-up is likely to do more damage to the Bush Administration than the people who outed a covert CIA operative (“the most insidious of traitors” — George H. W. Bush).

Justice John Roberts?

First impressions on Bush’s choice — neither unqualifed (Thomas), nor wacko (Bork), nor racist (Rehnquist), nor flame-throwing hypocrite (Scalia). Faint praise, to be sure, but praise nonetheless. And yes, he’s a Harvard man…I have to respect that. But is he a corporate shill? A Presidential apologist? Is he at heart someone who respects the rule of law and the checks and balances of the American system or someone who wants to recreate the Constitution in his image? He clerked for Rehnquist. Is he like the Chief Justice, someone whose rulings can almost entirely be predicted based on knowing who the parties are (corporations and government always win against individuals) rather than on what the facts and law might be?
I do not believe Roberts’ conservative views alone necessitate voting against him and certainly not filibuster. But it is far too soon to endorse or condemn a man with such a scant, barely two-year judicial record. If Roberts cooperates in the nomination process, it should give us the answers we need to decide.

A very special Two-Hour Debate Tuesday…
(Just after this show, Bush announced his pick to be Supreme Court Justice. He chose Judge John Roberts, former clerk to Chief Justice Rehnquist, to replace Sandra Day O’Connor on the Supreme Court. Roberts is a judge appointed by Bush to the D.C. Circuit Court of Appeals in 2003 who used to work for the Solicitor General’s office in the Bush Sr. and Reagan Administrations. I have an open mind on Judge Roberts. Though he is obviously a conservative, I will not make a decision on his nomination until I have reviewed his writings and witnessed his Senate testimony. If he — unlike Scalia or Thomas — does not wish to “legislate from the bench,” I will not be in favor of filibustering his nomination.)
But just before Bush made his choice, right-wing talk radio host Jim Greenfield and I made ours: not particular individuals, but the judicial philosophies we believe any future justice should follow. I believe a Justice should strictly abide by the language of the Constitution. Jim Greenfield claims to believe the same. Yet we obviously come to different conclusions…
